"For most people, they'll pass through a bankruptcy case and keep everything they have," says John Hargrave, a bankruptcy trustee in New Jersey. If you have a mortgage or a car loan, you can keep the property as long as you keep making payments (like the rest of us).
4. I'll never get credit again. Quite the contrary. It won't be long before you're getting credit card offers again. They'll just be from subprime lenders that will charge very high interest rates. "There are innumerable companies that will provide credit to you," says California bankruptcy attorney and trustee Howard Ehrenberg.
5. If you're married, both spouses have to file for bankruptcy. Not necessarily. "It's not uncommon for one spouse to have a significant amount of debt in their name only," Hargrave says. However, if spouses have debts they want to discharge that they're both liable for, they should file together. Otherwise, the creditor will simply demand payment for the entire amount from the spouse who didn't file.
6. It's really hard to file for bankruptcy. It's really not. Technically, you don't even need an attorney -- you can do the paperwork without one. However, going through the procedure alone is not recommended.
7. Only deadbeats file for bankruptcy. Most people file for bankruptcy after a life-changing experience, such as a divorce, the loss of a job or a serious illness. They've struggled to pay their bills for months and just keep falling further behind.
8. I don't want to include certain creditors in my filing because it's important to me to pay them back someday, and if the debt is discharged, I can't ever repay them. Bless you for even thinking about such a thing. You're no longer obligated to repay them, but you always have the opportunity. If your conscience won't let you sleep because you didn't pay your debts, there's nothing in the bankruptcy code that prevents you from doing that once you're back on your feet. But it is nearly impossible to leave any account with a balance out of your list of creditors. In general, all creditors receive notification of your bankruptcy filing, whether they are listed in the petition or not.
9. Filing for bankruptcy will improve my credit rating because all those debts will be gone. Filing for bankruptcy is the worst "negative" you can have on your credit report. Unlike other negatives, which stay on your report for seven years, bankruptcy can be there for 10 years, but you do get to rebuild your credit eventually.
10. You can't get rid of back taxes through bankruptcy. Generally speaking, this is true. However, there is such a thing as tax bankruptcy.

3. I'll lose everything I have. This is the misconception that keeps people who really should file for bankruptcy from doing it, says Chris Viale, the chief operating officer of Cambridge Credit Counseling in Massachusetts.
"They think the government will sell everything they have and they'll have to start over in a cardboard box," Viale says.
While bankruptcy laws vary from state to state, every state has exemptions that protect certain kinds of assets, such as your house, your car (up to a certain value), money in qualified retirement plans, household goods and clothing.
"For most people, they'll pass through a bankruptcy case and keep everything they have," says John Hargrave, a bankruptcy trustee in New Jersey. If you have a mortgage or a car loan, you can keep the property as long as you keep making payments (like the rest of us).
4. I'll never get credit again. Quite the contrary. It won't be long before you're getting credit card offers again. They'll just be from subprime lenders that will charge very high interest rates. "There are innumerable companies that will provide credit to you," says California bankruptcy attorney and trustee Howard Ehrenberg.
5. If you're married, both spouses have to file for bankruptcy. Not necessarily. "It's not uncommon for one spouse to have a significant amount of debt in their name only," Hargrave says. However, if spouses have debts they want to discharge that they're both liable for, they should file together. Otherwise, the creditor will simply demand payment for the entire amount from the spouse who didn't file.
6. It's really hard to file for bankruptcy. It's really not. Technically, you don't even need an attorney -- you can do the paperwork without one. However, going through the procedure alone is not recommended.
7. Only deadbeats file for bankruptcy. Most people file for bankruptcy after a life-changing experience, such as a divorce, the loss of a job or a serious illness. They've struggled to pay their bills for months and just keep falling further behind.

Choking Hazard - Kids Toy Keys with Remote Recalled
The U.S. Consumer Product Safety Commission has issued a recall of over 1 Million toy keys with remote imported by Battat Inc., of Plattsburgh, New York, the personal injury law firm of Schlyer & Associates, the Aggressive Trial Lawyers, is warning.

Borders Likely To Close Highland, Indiana Store Soon
Borders Books, the bankrupt 40-year-old bookseller, announced Monday that it will ask the bankruptcy court to liquidate and close all of its remaining stores, after no last-minute savior emerged for the company, the Affordable Bankruptcy law firm of Schlyer & Associates is advising.
Borders liquidation plan will be presented to the federal judge overseeing the company's bankruptcy case on Thursday.
What is left to unwind are Borders' 399 stores, about two-thirds of the locations it operated when it filed for bankruptcy in February. It currently has 10,700 employees, including the store in Highland, Indiana.
It appears Borders will begin closing its remaining stores as soon as Friday, with the liquidation sale expected to run through September if approved by the bankruptcy court.

Animated Safari and Aquarium Lamps Recalled - Fire / Shock Hazard
The U.S. Consumer Product Safety Commission announced a recall of 35,000 Animated Safari and Aquarium Lamps sold by Christmas Tree Shops the Northwest Indiana personal injury law firm of Schlyer & Associates is warning.

According to the recall notice, defective wiring in the lamps can cause an electrical short, posing fire and shock hazards to consumers. The recalled items were sold at Christmas Tree Shops stores primarily in the New England, Mid-Atlantic and Midwest regions from December 2009 through May 2011 for between $7 and $8.
If you have one of the recalled lights, you should immediately stop using the recalled lamps and return them to Christmas Tree Shops store for a full refund.

Gas Powered STIHL Yard Products Recalled - Burn Hazard

Drop-Side Cribs From Dream On Me Recalled
A popular baby crib is being recalled according to the U.S. Consumer Product Safety Commission the personal injury law firm of Schlyer & Associates is warning.
According to the USCPSC about 22,000 full-size and portable drop-side cribs are being recalled by Dream on Me, Inc. of Piscataway, New Jersey.
The USCPSC claims the hazards of these cribs are:
Full-Size Cribs: The drop-side rail hardware can break or fail, allowing the drop side to detach from the crib. When the drop-side rail partially detaches, it creates a space between the drop side and the crib mattress. An infant or toddler's body can become entrapped in the space, which can lead to strangulation and/or suffocation. A child can also fall out of the crib.
Portable Cribs: The drop-side rail hardware can break or fail, allowing the drop side to detach from the crib or fall unexpectedly. In addition, the portable crib mattress support hardware and the drop-side release latch can break easily, and the slats can loosen or break and detach from the crib. Children can also cut themselves on exposed hardware inside the cribs.
The recalled cribs were sold at Toys R Us, Walmart and Target stores nationwide and online at Amazon.com. The full-size cribs were sold from January 2006 to December 2009 for about $200. The portable cribs were sold from September 2007 to December 2009 for about $150.

According to the recall, the pizzas are recalled because they contain wheat and wheat is not declared on the pizza's label. Wheat is a known allergen.

The recall notice warns missing safety pegs can create a situation where the crib's drop-side rail disengages from the track. This can create a hazardous space in which an infant can become entrapped and suffocate.
This re-announcement pertains to cribs that were sold at major retail stores including Kmart, Target and Walmart between January 1995 and September 2007 for about $100.

According to the recall notice, the bottom of the pogo stick's frame tube can break or come apart and a pin holding the spring in place can break, posing laceration and fall hazards to consumers.
The recall involves the Rocket Stick Pogo, Pop Stick Pogo, Monster Stick Pogo and Twin Stick Pogo, according to the recall notice. The pogo sticks were sold at various stores nationwide and online by Web retailers from May 2010 through March 2011 for between $25 and $40.

Honda Civic Car Recalled - Fuel Leak Hazard - Northwest Indiana Personal Injury Attorney Warns
Over 18,000 2011 Honda Civics Recalled Merrillville Attorney Advises
The U.S. National Highway Traffic Safety Administration with Honda Motors has recalled over 18,000 model year 2011 Honda Civic cars due to the possibility that fuel will leak in a roll-over crash according to the recall notice.
"If a vehicle is involved in a roll-over crash, a cracked roll-over valve may allow fuel leakage from the gasoline tank into the evaporative emissions canister," Honda said in a statement.
According to the recall notice, a fuel leakage, in the presence of a ignition source, could result in a fire and injuries.
The recall is expected to begin on or before April 11, 2011, with dealers inspecting the fuel pump module and if necessary, replacing the module.
In Northwest Indiana, dealers can contact local dealer, Team Honda, on U.S. 30 in Hobart, Indiana for assistance.

I believe sometimes, us so called “professionals” need to take a step back and walk a mile in the other shoe. I know a lot about bankruptcy and sometimes I forget that my client, while nervous, scared or even embarrassed, knows very little about the process of filing for bankruptcy. It made me think, everyone should have some basic knowledge about bankruptcy and through a series of blogs, I want to share what I know.
Chapter 7 Bankruptcy
There are two basic types of bankruptcy available for people (not corporations). A Chapter 7 is a liquidation of all unsecured debt with the option of retaining or returning secured property. That sounds very impressive and lawyer-like doesn’t it? To say it another way, in a Chapter 7 you list all the debt you owe and you can keep the debt you decide to pay for, like a house or a car. The other debts, like credit cards, medical bills, signature loans, payday loans and mail order things, are discharged (or forgiven) and you would never have to pay those debts. If you decide you cannot afford to keep your house or a car, you have the option of giving the property back and owing that creditor nothing.
Chapter 13 Bankruptcy
A Chapter 13 is a reorganization of debt, a lot like credit counseling without the late fees, interest and collections. In a Chapter 13 we put together a budget based on your net income and your everyday routine living expenses (not including your debts, mortgage or car payments). This formula gives us an excess amount of income available for repayment of your debts. Once we agree this figure is accurate, we file your bankruptcy and that amount is paid to a trustee on a monthly basis and he pays your debts for you. He will focus first on secured debts, like a mortgage and cars. If he has money left over he will then make a distribution to your unsecured creditors. While you bankruptcy is pending creditors cannot attempt to collect the debt. At the end of your Chapter 13, your unsecured debts would be discharged and you would go back to making your mortgage payment.
