The Northwest Indiana personal injury law firm, Schlyer & Associates, the Aggressive Trial Lawyers, is warning of a recall issued by the U.S. Consumer Product Safety Commission of about 264,000 sippy cups sold at Target.

According to the recall notice, the Target Home Bunny Sippy Cup is being recall since the ear on the bunny sippy cup can poke a child in the eye area while using the cup for drinking, posing an injury hazard.

According to the notice, the recall involves two styles of Target Home Bunny Sippy Cups. The cups come with handles on both sides in pink and blue, female and male. Each contains a corresponding white bunny head screw-on lid and one bent ear and one straight ear. The cups can be identified by imprints on the bottom: "TARGET 200020683" for pink and "TARGET 200020884" for the blue.

The recalled cups were sold only at Target stores nationwide from February 2012 through April 5, 2012 for $3.

If you have any of the recalled cups sold at Target, you should immediately stop using the recalled sippy cups and return them to any Target store for a full refund or contact Target at (800) 440-0680.

According to the recall notice, the cribs' drop sides can malfunction, detach or otherwise fail, causing part of the drop side to fall out of position, creating a space into which an infant or toddler can roll and become wedged or entrapped, which can lead to strangulation or suffocation. A child can also fall out of the crib. Drop-side incidents can also occur due to incorrect assembly and with age-related wear and tear.

The recalled cribs were sold at J.C. Penney stores and online at jcpenney.com from January 2005 through December 2008 for between $150 and $400.

If you have one of the recalled cribs, you should immediately stop using the recalled cribs and contact Nan Far Woodworking at (877) 967-5770 for a free repair kit that will immobilize the drop side. In the meantime, find an alternate, safe sleep environment for the child such as a bassinet, play yard or toddler bed depending on the child's age.

There are many bankruptcy myths that scare many people.  MSN recently posted an article about bankruptcy myths that we will share with you?

With a mind toward declawing the monster, here are a dozen misconceptions about bankruptcy:

1. Everyone will know I've filed for bankruptcy. Unless you're a prominent person or a major corporation and the filing is picked up by the media, the chances are very good that the only people who will know about a filing are your creditors. While it's true that bankruptcy is a public legal proceeding, the number of people filing is so massive that very few publications have the space, manpower or inclination to run all of them, although some local newspapers do print the names of those who have filed in that community.

2. All debts are wiped out in Chapter 7 bankruptcy. You wish. Certain types of debts cannot be discharged, or erased. They include child support and alimony, student loans, restitution for a criminal act and debts incurred as the result of fraud.

3. I'll lose everything I have. This is the misconception that keeps people who really should file for bankruptcy from doing it, says Chris Viale, the chief operating officer of Cambridge Credit Counseling in Massachusetts.

"They think the government will sell everything they have and they'll have to start over in a cardboard box," Viale says.

While bankruptcy laws vary from state to state, every state has exemptions that protect certain kinds of assets, such as your house, your car (up to a certain value), money in qualified retirement plans, household goods and clothing.

"For most people, they'll pass through a bankruptcy case and keep everything they have," says John Hargrave, a bankruptcy trustee in New Jersey. If you have a mortgage or a car loan, you can keep the property as long as you keep making payments (like the rest of us).

4. I'll never get credit again. Quite the contrary. It won't be long before you're getting credit card offers again. They'll just be from subprime lenders that will charge very high interest rates. "There are innumerable companies that will provide credit to you," says California bankruptcy attorney and trustee Howard Ehrenberg.

5. If you're married, both spouses have to file for bankruptcy. Not necessarily. "It's not uncommon for one spouse to have a significant amount of debt in their name only," Hargrave says. However, if spouses have debts they want to discharge that they're both liable for, they should file together. Otherwise, the creditor will simply demand payment for the entire amount from the spouse who didn't file.

6. It's really hard to file for bankruptcy. It's really not. Technically, you don't even need an attorney -- you can do the paperwork without one. However, going through the procedure alone is not recommended.

7. Only deadbeats file for bankruptcy. Most people file for bankruptcy after a life-changing experience, such as a divorce, the loss of a job or a serious illness. They've struggled to pay their bills for months and just keep falling further behind.

8. I don't want to include certain creditors in my filing because it's important to me to pay them back someday, and if the debt is discharged, I can't ever repay them. Bless you for even thinking about such a thing. You're no longer obligated to repay them, but you always have the opportunity. If your conscience won't let you sleep because you didn't pay your debts, there's nothing in the bankruptcy code that prevents you from doing that once you're back on your feet. But it is nearly impossible to leave any account with a balance out of your list of creditors. In general, all creditors receive notification of your bankruptcy filing, whether they are listed in the petition or not.

9. Filing for bankruptcy will improve my credit rating because all those debts will be gone. Filing for bankruptcy is the worst "negative" you can have on your credit report. Unlike other negatives, which stay on your report for seven years, bankruptcy can be there for 10 years, but you do get to rebuild your credit eventually.

10. You can't get rid of back taxes through bankruptcy. Generally speaking, this is true. However, there is such a thing as tax bankruptcy.

11. You can only file for bankruptcy once. The truth is, you can file for Chapter 7 bankruptcy only once every eight years, says Justin Harelik, Bankrate's bankruptcy adviser. For Chapter 13 reorganization, you can file more often than that.

Of course, that doesn't make it a good idea.

"Multiple bankruptcies are really bad," Rosenberg says. "Many people get into the habit of once they've done it, it becomes a way of life. This is not good for your karma." Or your credit rating.

12. I can max out all my credit cards, file for bankruptcy and never pay for the things I bought.That's called fraud, and bankruptcy judges can get really cranky about it.

The U.S. Consumer Product Safety Commission has issued a recall of certain  LHQM LED Exit Signs with Emergency Lights manufactured by Best Lighting Products, of Pataskala, Ohio the Northwest Indiana personal injury law firm of Schlyer & Associates, the Aggressive Trial Lawyers is warning.

According to the recall notice, the fixtures can malfunction and fail to illuminate in the event of a power failure. This could result in a failure to provide adequate lighting to guide building occupants to an exit in the event of an emergency.

The recalled exit signs have emergency lights fixed at either end with "EXIT" in red or green in the center. The fixtures are installed in commercial buildings, such as hotels and office buildings.

The recalled EXIT signs were sold at authorized distributors nationwide from January 2011 through May 2011 for $100 to $200.

The U.S. Consumer Product Safety Commission  has issued a recall of over 1 Million toy keys with remote imported by Battat Inc., of Plattsburgh, New York, the personal injury law firm of Schlyer & Associates, the Aggressive Trial Lawyers, is warning.

Borders Books, the bankrupt 40-year-old bookseller, announced Monday that it will  ask the bankruptcy court to liquidate and close all of its remaining stores, after no last-minute savior emerged for the company, the Affordable Bankruptcy law firm of Schlyer & Associates is advising.

Borders liquidation plan will be presented to the federal judge overseeing the company's bankruptcy case on Thursday.

What is left to unwind are Borders' 399 stores, about two-thirds of the locations it operated when it filed for bankruptcy in February. It currently has 10,700 employees, including the store in Highland, Indiana.

It appears Borders will begin closing its remaining stores as soon as Friday, with the liquidation sale expected to run through September if approved by the bankruptcy court.

The U.S. Consumer Product Safety Commission announced a recall of 35,000 Animated Safari and Aquarium Lamps sold by Christmas Tree Shops the Northwest Indiana personal injury law firm of Schlyer & Associates is warning.

According to the recall notice, defective wiring in the lamps can cause an electrical short, posing fire and shock hazards to consumers.  The recalled items were sold at Christmas Tree Shops stores primarily in the New England, Mid-Atlantic and Midwest regions from December 2009 through May 2011 for between $7 and $8.

If you have one of the recalled lights, you should immediately stop using the recalled lamps and return them to Christmas Tree Shops store for a full refund.

A popular baby crib is being recalled according to the U.S. Consumer Product Safety Commission the personal injury law firm of Schlyer & Associates is warning.

According to the USCPSC about 22,000 full-size and portable drop-side cribs are being recalled by Dream on Me, Inc. of Piscataway, New Jersey.

The USCPSC claims the hazards of these cribs are:

Full-Size Cribs: The drop-side rail hardware can break or fail, allowing the drop side to detach from the crib. When the drop-side rail partially detaches, it creates a space between the drop side and the crib mattress. An infant or toddler's body can become entrapped in the space, which can lead to strangulation and/or suffocation. A child can also fall out of the crib.

Portable Cribs: The drop-side rail hardware can break or fail, allowing the drop side to detach from the crib or fall unexpectedly. In addition, the portable crib mattress support hardware and the drop-side release latch can break easily, and the slats can loosen or break and detach from the crib. Children can also cut themselves on exposed hardware inside the cribs.

The recalled cribs were sold at Toys R Us, Walmart and Target stores nationwide and online at Amazon.com. The full-size cribs were sold from January 2006 to December 2009 for about $200. The portable cribs were sold from September 2007 to December 2009 for about $150.

Due to a heart attack risk, the FDA is ordering Avandia to be taken from retail stores in November, according to an FDA release last week.

New changes will be put into place starting November 18, which will only allow certified doctors to prescribe the drug.  Avandia will only be able to prescribed to patients who have been informed of the risks and who will fill the prescription by mail, through only certain pharmacies.

Chevrolet has recalled over 150,000 of its popular Cruze cars to ensure the steering shaft was properly installed the Northwest Indiana personal injury & bankruptcy law firm of Schlyer & Associates is warning.

What Bankruptcy Can and Cannot Do For You.

I am an attorney at Schlyer & Associates in Merrillville Indiana and help people file for bankruptcy relief in Lake County and Porter County, Indiana.  We are a debt relief agency.  There are some very real benefits to filing for Bankruptcy relief under Chapter 7 or Chapter 13 of the bankruptcy code.

However, there are also drawbacks to filing bankruptcy.  Let’s talk about bankruptcy like it was a Clint Eastwood movie:   the good, the bad and the ugly.

Bankruptcy can eliminate most debts and make it so that you do not have to pay them.  Some debt you just cannot get rid of, mostly debts owed to the government and debts relating to family law.  However, in a Chapter 7 bankruptcy, most debt is discharged, such as medical bills, credit cards and pay day loans.  In a Chapter 13, debt is paid through a repayment plan proposed by you and debt not paid in full is discharged at the end.  Bankruptcy will stop all creditor harassment, telephone calls, collection, lawsuits, garnishments, foreclosures and other actions by creditors.  In some instances in a Chapter 13 bankruptcy, interest rate on car loans can be lowered, allowing you to pay back less than what is owed on your vehicle.  Bankruptcy can help eliminate stress over past due or old debts.

The Bad. Bankruptcy is not something most people enter into lightly.  It is very emotional for some, stressful and embarrassing for others.  Some people feel like is a failure to have to file for bankruptcy relief.  Some people feel guilty for not paying their debts.  Bankruptcy is damaging to your credit.  Do not let anybody tell you different.  Bankruptcy stays on your credit report for up to seven years.  Bankruptcy does not wipe out the debt listed on your credit reports.  Bankruptcy can cause you to have to pay a higher interest rate for loans long after your bankruptcy is over.  A collection or lawsuit on your credit will cause these same “bad” things as well.

The recall notice warns missing safety pegs can create a situation where the crib's drop-side rail disengages from the track. This can create a hazardous space in which an infant can become entrapped and suffocate.

This re-announcement pertains to cribs that were sold at major retail stores including Kmart, Target and Walmart between January 1995 and September 2007 for about $100.

Over 18,000 2011 Honda Civics Recalled Merrillville Attorney Advises

The U.S. National Highway Traffic Safety Administration with Honda Motors has recalled over 18,000 model year 2011 Honda Civic cars due to the possibility that fuel will leak in a roll-over crash according to the recall notice.

"If a vehicle is involved in a roll-over crash, a cracked roll-over valve may allow fuel leakage from the gasoline tank into the evaporative emissions canister," Honda said in a statement.

According to the recall notice, a fuel leakage, in the presence of a ignition source, could result in a fire and injuries.

The recall is expected to begin on or before April 11, 2011, with dealers inspecting the fuel pump module and if necessary, replacing the module.

In Northwest Indiana, dealers can contact local dealer, Team Honda, on U.S. 30 in Hobart, Indiana for assistance.

I believe sometimes, us so called “professionals” need to take a step back and walk a mile in the other shoe. I know a lot about bankruptcy and sometimes I forget that my client, while nervous, scared or even embarrassed, knows very little about the process of filing for bankruptcy.  It made me think, everyone should have some basic knowledge about bankruptcy and through a series of blogs, I want to share what I know.

Chapter 7 Bankruptcy

There are two basic types of bankruptcy available for people (not corporations).  A Chapter 7 is a liquidation of all unsecured debt with the option of retaining or returning secured property. That sounds very impressive and lawyer-like doesn’t it?  To say it another way, in a Chapter 7 you list all the debt you owe and you can keep the debt you decide to pay for, like a house or a car.  The other debts, like credit cards, medical bills, signature loans, payday loans and mail order things, are discharged (or forgiven)  and you would never have to pay those debts. If you decide you cannot afford to keep your house or a car, you have the option of giving the property back and owing that creditor nothing.

Chapter 13 Bankruptcy

A Chapter 13 is a reorganization of debt, a lot like credit counseling without the late fees, interest and collections.  In a Chapter 13 we put together a budget based on your net income and your everyday routine living expenses (not including your debts, mortgage or car payments).  This formula gives us an excess amount of income available for repayment of your debts.  Once we agree this figure is accurate, we file your bankruptcy and that amount is paid to a trustee on a monthly basis and he pays your debts for you.  He will focus first on secured debts, like a mortgage and cars. If he has money left over he will then make a distribution to your unsecured creditors.  While you bankruptcy is pending creditors cannot attempt to collect the debt.  At the end of your Chapter 13, your unsecured debts would be discharged and you would go back to making your mortgage payment.

Infant Slippers Sold Exclusively at Walgreens Recalled Due to Choking Risk

The Northwest Indiana law firm Schlyer & Associates warns parents of a recall issued by the U.S. Consumer Product Safety Commission regarding holiday rattle baby slippers.

About 57,000 slippers are recalled since internal stuffing and the rattle inside the slippers decorative figures can be pulled out, posing a choking hazard to young children, according to the recall notice.

According to the notice, the recalled slippers are decorated with stuffed fabric figures including snowmen, Santa, reindeer, and penguins, and have decorative rattles inside the slippers that sound like bells when shaken.

If you or a loved one has any of the recalled slippers, you should immediately stop using the slippers and return them to any Walgreen location for a full refund.

Fire and Fall Hazard - Wall Mounted Fireplaces Recalled

The Lake County, Indiana law firm, Schlyer & Associates warns, wall mounted fireplaces imported by Southern Enterprises Inc. (SEI) of Coppell, Texas have been recalled.

According to the recall notice published by U.S. Consumer Product Safety Commission, Colin Cowie Gel-Fuel Wood Fireplaces are recalled since heat from the operating unit causes the plastic mounting screws to deform causing the unit to fall from the wall, posing a fall and fire hazard.

The fireplaces were sold by the Home Shopping Network between October and November 2010 for about $250.  If you have a recalled wall mounted fireplace, you should immediately stop using the wall mounted fireplace and call SEI for a corrective retro fit kit that will be sent free of charge at (877) 858-4959.

Fire & Burn Hazard From Fuel Leak on Dirt Bikes - Recall Issued

Dirt Bikes imported by Baja, Inc. have been recalled according to a notice published by the U.S. Consumer Product Safety Commission.  The dirt bikes were sold by  Pep Boys stores nationwide from December 2010 through January 2011 for between $550 and $650.

According to the recall notice, fuel can leak from the fuel tank, posing a fire and burn hazard to consumers.

Recall Issued for Baby Jogger Jump Seats - Fall Hazard

Ford Issues Recall of 144,000 F-150 Pickup Trucks - Schlyer & Associates Advises

The Merrillville law firm Schlyer & Associates advises Ford has recalled 144,000 F-150 pickup trucks because their front air bags may deploy unexpectedly.

The pick-up trucks affected are model years 2005-06.  The U.S. National Highway Traffic Safety Administration requested the recall the trucks.

The Lake County, Indiana law firm Schlyer & Associates warns of a recall.   B.O.B. Trailers Inc., of Boise, Idaho  in cooperation with the U.S. Consumer Product Safety Commission has issued a voluntary recall of B.O.B.single and double strollers.

The recall warns "a drawstring on the stroller can get wrapped around a child’s neck, posing a strangulation hazard."

The strollers affected were manufactured between April 2002 and March 2010.  Many of the strollers affected by the recall are popular among runners for their young children.

If you own a B.O.B. stroller, you should immediately check B.O.B. Trailers Inc., to determine if your stroller is affected by the recall.

If your stroller is listed on the B.O.B. Trailers Inc. website , you should immediately stop using the recalled strollers and remove the drawstring according to the recall.

Fire Hazard - Heaters Sold at Dollar General Subject to Recall

The Lake County, Indiana law firm, Schlyer & Associates warns heaters sold by Dollar General were recently recalled.

There are reports of the heaters overheating and damaging electrical outlets and walls.  Both heater fans and and radiant heaters are involved in the recall.

The heaters were manufactured by Atico International USA, Inc and sold exclusively by Dollar General.  It was reported about 92,000 units are affected by the recall.

The U.S. Consumer Product Safety Commission has posted the recall and photos of the Dollar General heaters affected.

You should immediately check your heater is affected by the recall.  If your heater is affected by the recall, you should stop using the heater and return them to any Dollar General Store for a full refund.
